SCREENTOCARE BY MAMACARE360

Provider Terms of Service

Version 1.1. Effective October 5, 2026.

These Provider Terms of Service (the "Terms") govern use of ScreenToCare by health care providers, doulas and other birth workers, and their authorized staff. ScreenToCare is operated by WeConnect LLC, doing business as ScreenToCare by MamaCare360 ("ScreenToCare," "we," "us"). By creating an account or checking the boxes at signup, you agree to these Terms on behalf of yourself and your practice.

1. Who can use ScreenToCare

You must be a health care provider, a doula or other birth worker, or staff authorized by one. The information you give us, including any NPI, must be accurate and kept current. At signup you'll tell us whether you're a licensed clinician; Section 9 applies if you're not.

2. What ScreenToCare does

ScreenToCare gives your practice a QR code to display for patients. A patient scans it and completes validated screening questionnaires on her own phone, with no app or account: PHQ-9 during pregnancy, EPDS-US after birth, GAD-7 for anxiety, and HITS for intimate partner violence. Her phone scores the screening, shows crisis resources when needed and suggests next steps. When she taps Submit, her phone creates a results document, which she sends by email from her own account to the address your practice designates.

ScreenToCare is designed not to receive patient information. A patient's phone sends only anonymous signals when a questionnaire is started or completed, which we combine into monthly totals. Your dashboard shows those totals only: screens started, completed and billable, by questionnaire. It never shows names, scores, results or the time of any screening. HITS results are shown only to the patient and are never shared with you.

3. Your clinical responsibility

ScreenToCare is a screening tool. It does not diagnose, treat or provide emergency services, and it does not replace your clinical judgment. You are responsible for reviewing results patients send you and for all diagnosis, treatment and referral decisions. You'll apply your own policies on minors' consent and parental access to any results you receive.

4. High-risk results

When a patient gives a positive answer to a self-harm question, her phone shows a crisis screen with one-tap access to 988, 24/7 support from the National Maternal Mental Health Hotline, and 911 for immediate danger, which she must acknowledge before seeing her results. The results document she sends you notes the crisis answer.

ScreenToCare does not notify you about any individual screening, including crisis answers, and no one at ScreenToCare monitors screenings. Patients may also scan your QR code and screen outside your office, in which case you'll see results only when they send them. Your practice is responsible for asking patients to send their results before they leave, monitoring the email address where results arrive, and responding to high-risk results according to your clinical protocols.

5. Your QR code and results email

You'll display your QR code where your patients can scan it, and keep the email address for receiving results current and monitored.

6. Billing and coding

CPT code and billing information from ScreenToCare is informational and is not billing or legal advice. Payer rules vary. Your practice is responsible for correct coding, documentation and billing.

7. Fees

A "Billable Screen" is each completed PHQ-9, EPDS-US or GAD-7 questionnaire. Started but unfinished questionnaires and HITS screens are never billed. ScreenToCare costs $1 per Billable Screen, invoiced monthly on the 1st through Stripe. There is no subscription or setup fee. Taxes, if any, are additional. We'll give you at least 30 days' notice of any price change, except as provided below.

Founding Provider Rate. If your account was created on or before October 9, 2026, the fee for each Billable Screen will remain $1 for as long as your account stays continuously active and in good standing. The Founding Provider Rate ends if (a) you close your account, (b) we terminate your account for breach, or (c) your account has no Billable Screens for 12 consecutive months. It applies to ScreenToCare's screening service as described in these Terms, not to new products or optional features, and it is not transferable except to a successor that acquires your practice. This rate does not prevent us from discontinuing ScreenToCare on at least 90 days' notice.

8. Patient information and HIPAA

ScreenToCare is designed so that it does not receive, maintain or transmit protected health information. Results are created on the patient's own phone and sent directly from her to you, and once you receive them, your practice is responsible for protecting them. As currently designed, ScreenToCare does not act as your business associate. If that ever changes, we'll offer a business associate agreement before ScreenToCare handles any protected health information.

9. Doulas and other birth workers

If you sign up as a doula or other birth worker, this section applies in place of Sections 3 and 6. You don't diagnose or treat, and you'll use ScreenToCare only to support your clients and connect them to care. If a client shares a high-risk result with you, you'll encourage her to contact a licensed clinician, and to call or text 988 in a crisis, as described in the ScreenToCare Doula Guide or your own written plan. Most birth workers aren't covered by HIPAA, so you'll keep any results your clients send you confidential and use them only to support their care. Fees in Section 7, including the Founding Provider Rate, apply to birth workers in the same way.

10. Accounts and security

Keep your login credentials confidential, give access only to authorized staff, and tell us promptly at hello@screentocare.com if you suspect unauthorized access.

11. Acceptable use

Use ScreenToCare only for patient care. Don't misuse it, interfere with it, copy or reverse engineer it, or use it to screen people for employment, insurance or any purpose other than their care.

12. Intellectual property

ScreenToCare and its software, design and content belong to us. Screening questionnaires remain the property of their authors and are used in accordance with their terms.

13. Disclaimers

ScreenToCare is provided "as is." Screening tools can miss conditions or flag people who don't have them. We don't guarantee that ScreenToCare will be uninterrupted or error-free, or that any patient will send results or follow suggested next steps.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, (A) NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUE, ARISING OUT OF THESE TERMS OR SCREENTOCARE, EVEN IF ADVISED OF THEIR POSSIBILITY; AND (B) SCREENTOCARE'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR SCREENTOCARE WILL NOT EXCEED THE GREATER OF THE FEES YOU PAID IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR $500. THESE LIMITS DO NOT APPLY TO A PARTY'S GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR INDEMNIFICATION OBLIGATIONS, OR TO YOUR OBLIGATION TO PAY FEES.

15. Indemnification

You will defend, indemnify and hold harmless ScreenToCare and its officers, members and contractors from third-party claims, losses and expenses (including reasonable attorneys' fees) arising from (a) your clinical care or client support, including diagnosis, treatment, referral and response to screening results; (b) your failure to monitor your results email or follow your clinical protocols or escalation plan; (c) your coding, documentation or billing; (d) your handling of results documents you receive; or (e) your breach of these Terms. ScreenToCare will defend and indemnify you from third-party claims that the ScreenToCare software, as provided by us, infringes a U.S. intellectual property right, excluding the screening questionnaires and any claims arising from your modification or misuse. The indemnified party must give prompt notice, allow the indemnifying party to control the defense, and reasonably cooperate.

16. Ending these Terms

You can stop using ScreenToCare at any time. We may suspend or end your access if you breach these Terms or if required by law, and we may discontinue ScreenToCare on at least 90 days' notice. Fees for completed Billable Screens remain payable.

17. Changes

We may update these Terms. We'll notify you by email at least 30 days before material changes take effect, and continued use after that means you accept them.

18. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules, except where preempted by federal law. Any dispute will be brought exclusively in the state or federal courts located in Fulton County, Georgia, and the parties consent to their jurisdiction.
